Terms and Conditions

In order to participate in above event, Cinderella’s Enchanted Parties Ltd. requires that all parents of participants electronically sign this form prior to attending the Event and agree to the terms of the agreement below.

IN CONSIDERATION of being permitted to participate in any way in the event set forth above (the

“Event”), EACH OF THE PARTICIPANTS, for himself, his parents, his children, his personal representatives, executors, heirs, administrators, next of kin and legal representatives:

1.ACKNOWLEDGES, AGREES, AND REPRESENTS that he or she (a) is not under the influence of alcohol, or drugs, or any other substance that could impair the undersigned’s judgment, vision, or motor skills, (b) does not have any medical condition that impairs the undersigned’s judgment, vision, or motor skills, and (c) will at all times follow the instructions and directions of the instructor during the Event. Each of the undersigned also acknowledges that accidents can occur while participating in the Event and represent that they are voluntarily participating in the Event with knowledge of the dangers involved, and agree to accept any and all risks of injury or death.

2. HEREBY RELEASES, WAIVES, DISCHARGES AND COVENANTS NOT TO SUE Cinderella’s Enchanted Parties Ltd., its volunteers, sponsors, principals, members, managers, officers, agents, employees, successors and assigns, other attendees at the Event and each of them, all for the purposes herein referred to as “Releasees”, FROM ANY AND ALL LIABILITY TO THE UNDERSIGNED, his or her personal representatives, assigns, heirs, and next of kin, FOR ANY AND ALL LOSS, DAMAGE, CLAIMS, DEMANDS, CAUSES OF ACTION, WHETHER THE SAME BE KNOWN, ANTICIPATED OR UNANTICIPATED, OF EVERY KIND, NATURE AND DESCRIPTION, WHETHER PRESENT OR FUTURE, ON ACCOUNT OF INJURY TO THE PERSON OR PROPERTY OF THE UNDERSIGNED OR RESULTING IN DEATH OF THE UNDERSIGNED arising out of or related to the Event or the use or intended use of the facilities, equipment, or class materials provided by Cinderella’s Enchanted Parties Ltd., its volunteers and sponsors.

3. HEREBY AGREES TO INDEMNIFY AND SAVE AND HOLD HARMLESS the Releasees and each of them FROM ANY AND ALL LOSS, LIABILITY, DAMAGE, OR COST the undersigned may incur arising out of or related to the undersigned’s participation in the Event or the use or intended use of the facilities, equipment, or materials provided by Cinderella’s Enchanted Parties Ltd.,its volunteers and sponsors.

4. HEREBY AGREES that this Release and Waiver of Liability, Assumption of Risk and Indemnity Agreement may be pleaded in bar to any action brought by the undersigned, or his or her personal representatives, executors, heirs, administrators, next of kin and legal representatives, arising out of or related to the Event or class materials provided by Cinderella’s Enchanted Parties Ltd., it’s volunteers and sponsors.

5. HEREBY ACKNOWLEDGES THE RISK OF BODILY INJURY, DEATH, OR PROPERTY DAMAGE arising out of or related to the Event or the use or intended use of the class materials, WHETHER CAUSED BY THE NEGLIGENCE OF RELEASEES OR OTHERWISE.

6. HEREBY AGREES that this Release and Waiver of Liability and Assumption of Risk and EXTENDS TO ALL ACTS OF NEGLIGENCE BY THE RELEASEES, INCLUDING, but not limited to, NEGLIGENT RESCUE OPERATIONS and is intended to be as broad and inclusive as is permitted by the laws of the Cayman Islands in which the Event is conducted and that if any portion thereof is held invalid, it is agreed that the balance shall, notwithstanding, continue in full legal force and effect.

7. HEREBY GRANTS permission to Cinderella’s Enchanted Parties Ltd., to take and use photographs, video and/or digital images of my child for use in news releases and marketing materials. These materials might include printed or electronic publications, websites or other electronic communications. I further agree that my child’s name and identity may be revealed in descriptive text or commentary in connection with the image(s). I authorize the use of these images without compensation to me. All negatives, prints, digital reproductions shall be the property of Cinderella’s Enchanted Parties Ltd.

8. HEREBY AGREES to pay in full, the amount detailed below at least 48 hours prior to the start of the event and accepts that they will not be eligible to any refund in cash or kind if the participant chooses to no longer attend or the participant is no longer able to attend.

I HAVE READ THIS RELEASE AND WAIVER OF LIABILITY, ASSUMPTION OF RISK AND INDEMNITY AGREEMENT, FULLY UNDERSTAND ITS TERMS, UNDERSTAND THAT I HAVE GIVEN UP SUBSTANTIAL RIGHTS BY SIGNING IT AND HAVE SIGNED IT FREELY AND VOLUNTARILY WITHOUT ANY INDUCEMENT, ASSURANCE, OR GUARANTEE BEING MADE TO ME AND INTEND MY SIGNATURE TO BE A COMPLETE AND UNCONDITIONAL RELEASE OF ALL LIABILITY TO THE GREATEST EXTENT ALLOWED BY LAW.
